All orders placed within conditions of receiving a Gift With Purchase promotion are valid for regular returns.

If you opt for a refund for your return, your Gift With Purchase item must also be returned in unopened and unworn conditions.

If you decide to return an item without returning the Gift With Purchase item(s), our standard returns policy will be void and a credit note will be provided for your return.

Terms and Conditions

  1.     Information regarding prizes, how to enter and terms applicable to the particular promotion that you are entering, form part of these terms and conditions (Terms). By entering, you accept the Terms. By participating in any competition you are deemed to have accepted the Terms.

 

  1.     The Promoter is Kirstin Ash Pty Ltd (ABN 36 130 254 321) of  co/Bell Partners Suite 602, Level 6, 2-8 Brookhollow Avenue, Norwest, NSW, 2153 (“Promoter”).
  2.     Nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any consumer rights under any applicable law including the Australian Consumer Law.

Conditions of Entry

  1.     To take part in this promotion you must be an Australian resident aged 18 years or older. Directors, management and employees of the Promoter and associated companies and agencies as well as the immediate families of each of these people are not eligible to enter. If it is found out that a winner is in breach of any of these requirements, they will be automatically disqualified.
  2.     The promotions starts at 10am on 29th October 2024 and finishes at 11.59 pm on 5th November 2024 (“Promotional Period”). All valid entries must be received by the Promoter during the Promotional Period.


  3.     Entry to the promotion is via the link https://au.kirstinash.com/pages/resort-giveaway on the www.kirstinash.com website where you can choose the promotion that you would like to enter. Details of how the promotion will be run including prize details, how to enter, time and method of draw will be on the www.kirstinash.com website.

 

  1.     To enter, you must:

 

(a)   Visit the www.kirstinash.com website and click on the link https://au.kirstinash.com/pages/resort-giveaway, fill out the entry form which will include entering your name, email, date of birth, telephone number and Instagram handle;

(b)   Like the post on @kirstinash Instagram account promoting the Kirstin Ash Resort Giveaway promotion and tag a friend in the comments section on this post; and

(c)   Follow @kirstinash Instagram Accounts.

 

 

Prizes

  1. The prize is outlined as follows:

 

  •   Kirstin Ash Gift Voucher at the value of AU$1000. 



Kirstin Ash Gift Voucher

  1. The Kirstin Ash Gift Voucher is valid for three (3) years from the date of issue and valued at one thousand Australian dollars (AUD$1000). The Gift Voucher will be valid for use only at the www.kirstinash.com online store. Total prize value is AU$1000.

 

  1. The Kirstin Ash Winter Giveaway Competition winner will be drawn on the 5th of November 2024 at 10 am at 32 York St, Sydney NSW 2000. 

 

  1. The winner will be contacted on the 5th of November 2024 via the email address provided. The prizes will be sent via email. If a prize is required to be sent by post, the winner will be asked to provide their mailing address details.
  2. Any prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter is not liable if there is any variation in the value of any prize.

 

  1. Multiple entries are accepted.
  2.   The Promoter is not liable in any way if your name, address, email address or any other information that you gave to the Promoter is incorrect or if you fail to comply with the terms of any email or fail to collect the prize.
  3.   The Promoter reserves the right to void any entry that is in breach of these Terms at its sole discretion.

 

  1. The winner will be randomly drawn by the Promoter.
  2.   For prizes that can be posted, they can only be sent to Australian addresses using the Australia Post network and the Promoter has no liability for any lost or damaged prizes once they are sent. The Promoter reserves the right to verify your identification prior to awarding the prize.
  3.   Only the winner will be notified by email and must respond within seven days of the notification email being sent by the Promoter. If the Promoter does not receive a response within this time, the prize may be reallocated and given to one of the remaining entrants at the sole discretion of the Promoter.

 

  1. If a redraw is required, it will take place on the 13th of November 2024 at 10am at 32 York St, Sydney NSW 2000.

  

  1.   If the prize is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prizes with gift/s of equal value and/or specification, subject to any written directions from a regulatory authority.
  2.   All entries in a promotion become the property of the Promoter. By entering the promotion, you consent to your name being disclosed on the @kirstinash Instagram page and the www.kirstinash.com website (if you are a winner). The collection and use of an entrant’s personal information is otherwise subject to and in compliance with the Promoter’s Privacy Policy, available at [https://au.kirstinash.com/pages/privacy-policy].

 

  1.   The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

 

  1.   If the operation, security or integrity of the promotion is compromised for any reason beyond the Promoter’s reasonable control, including non-authorised human intervention or tampering, the Promoter may suspend, modify or terminate the promotion. If the promotion is terminated before its stated end date, the Promoter may award prizes based on the entries received before that date.

 

  1.   The Promoter is not responsible for any tax incurred by the winner as a result of the prize and is not responsible for any costs associated with the prize once the prize has been awarded.

 

  1.   The Promoter’s decision is final and no correspondence will be entered into.
  2.   The Kirstin Ash Resort Giveaway Competition is in no way sponsored, endorsed or administered by, or associated with Instagram or any other platform operator (“Platform Operator”).

 

  1.   The following terms apply to the extent that the Promotion is conducted on, advertised or promoted on a social media platform owned by a third party:

 a) each Entrant acknowledges and agrees that the Promotion is in no way sponsored, endorsed or administered by, or associated with, any Platform Operator;

b) each Entrant releases each Platform Operator and its associated companies from all liabilities arising in respect of the Promotion;

c) to the extent relevant to the Promotion, the Promoter agrees and each Entrant must agree to adhere to the prevailing terms and conditions of each Platform Operator;

d) Entrants understand that they are providing their information to the Promoter and not to the Platform Operator;

e) Entrants are solely responsible and liable for any content or information they transmit to other users of the Platform Operator; and

f) any questions, comments or complaints about the Promotion must be directed to the Promoter not the Platform Operator
